Judge denies Jensen's motion for change of venue; appeal planned
Dane County Judge David Flanagan today denied a motion by lawyers for former Assembly Speaker Scott Jensen to have the retrial of his misconduct in office charges moved to his home county of Waukesha.
Jensen attorney Ryan Stoll immediately said he plans to appeal the ruling.
Lawyers for Jensen cited the new ethics reform law that grants lawmakers the right to be prosecuted in their home counties, but Dane County DA Brian Blanchard argued the case pre-dates the new rules.
Flanagan sided with the prosecution, saying the charges were filed a full five years before the establishment of the Government Accountability Board, the body that now oversees ethics cases.
